Why this is important under RRA 2026
The RRA 2026 possession framework increases the importance of correct notices, accurate evidence and clear compliance records. Weak possession claims often fail because documents are missing, notice details are wrong, or evidence has not been prepared properly.
This checklist helps landlords and agents identify gaps before formal court action, reducing the risk of delay, dismissal or wasted costs.
When should landlords use this checklist?
Use this document before issuing proceedings, before referring a matter to legal support, or where a Section 8 notice has been served and the landlord is considering the next stage.
Evidence and compliance checks
- Check that the tenancy agreement and parties are correct
- Confirm deposit protection and prescribed information compliance
- Check the correct Section 8 notice and grounds were used
- Confirm proof of service is retained
- Review rent ledger, breach evidence, witness evidence and correspondence
- Record any tenant vulnerability or pre-action engagement
Important legal note
Possession proceedings are technical. Landlords should seek professional legal support where the facts are disputed, the grounds are complex, arrears are unclear, compliance is incomplete, or court action is likely.
