Landlord Fined Over Unauthorised Property Extension in Uxbridge

A landlord and his property management company have been fined a total of £7,589 for failing to demolish an unauthorised home extension. The case highlights the importance of adhering to planning regulations and enforcement notices for landlords and property professionals.

Background to the Enforcement Action

Saad Ahmad, a landlord from The Larches, Uxbridge, appeared at Uxbridge Magistrates’ Court after breaching planning control regulations. The issue concerned an unauthorised front porch and first-floor side room extension at his property located at 15 Lynhurst Crescent.

Following complaints from local residents, planning enforcement officers investigated the property in November 2022 and identified the unauthorised works. Ahmad subsequently submitted a retrospective planning application in February 2023, which was refused by the local authority.

Planning Appeal and Enforcement Notices

Ahmad appealed the refusal, but the Planning Inspectorate dismissed his appeal in September 2023. The Inspectorate described the extension as having an “unattractive box-like and blocky outline which is out of rhythm with other dwellings” in the area.

Despite being ordered by enforcement officers to remove the unauthorised extension within 28 days, Ahmad did not comply. Instead, he submitted an amended retrospective application with changes to the roof design, which was also refused in May 2024.

In response, Hillingdon Council issued a planning enforcement notice in August 2024, requiring the removal of the extension by December 2024. As of now, the extension has not been fully removed, and the council continues to engage with Ahmad to ensure compliance.

Legal Consequences and Fines

At court, Ahmad admitted to breaching planning control regulations and failing to comply with the enforcement notice. His company, Optimum Asset Investments Ltd, was fined £3,000 and ordered to pay a victim surcharge of £1,200, as well as prosecution costs of £3,363 to Hillingdon Council.

Ahmad himself received an 18-month conditional discharge and was ordered to pay a victim surcharge of £26. The total financial penalty imposed amounts to £7,589.
