Government pledges millions of pounds in free legal support for tenants

Government pledges millions of pounds in free legal support for tenants

The UK government has announced a £20 million investment to provide free legal support and advice for tenants facing eviction. This funding aims to assist vulnerable households in accessing early help to avoid court proceedings, which is significant for landlords as it may reduce prolonged disputes and improve communication between tenants and landlords.

For landlords and letting agents, understanding the implications of this support is crucial, as it may influence eviction processes and tenant relations. Early intervention could lead to more constructive resolutions, potentially easing the burden on the court system and reducing delays in possession cases.

Government funding to support tenants at risk of eviction

The government’s £20 million funding package is designed to provide vulnerable tenants with free legal advice and support before they face eviction in court. According to a government press release, this initiative aims to help those at risk of eviction and debt to “get the help they need before they end up in court faced with the prospect of a costly legal bill they can’t afford.”

In addition to eviction support, the funding will also assist individuals with debt problems by offering early advice to prevent their financial situation from worsening. Deputy Prime Minister David Lammy emphasised the importance of this support, stating: “It is absolutely vital that those facing some of life’s most challenging situations, such as debt, eviction, family issues, are able to access the support they need.”

He added that the funding will ensure essential legal support is available to those who need it most and will contribute to putting the sector on a sustainable footing as part of the government’s Plan for Change.

Implications for landlords and the housing sector

Propertymark has welcomed the government’s funding, recognising its potential to support vulnerable households and encourage landlords and lenders to work constructively to prevent disputes escalating to court. However, Propertymark also highlights the ongoing issue of court backlogs, which continue to affect the housing justice system.

As stated by Propertymark, “access to justice is a critical part of a well-functioning housing sector.” Delays and under-resourcing in the courts can be detrimental to tenants, landlords, and agents, often prolonging disputes and increasing costs for all parties involved.

Propertymark has consistently called for reforms to improve efficiency, fairness, and confidence in housing justice. This includes ensuring that people facing possession proceedings can access timely legal advice, while also enabling landlords to resolve legitimate cases without excessive delay.

In their engagement with Parliament, including debates in the House of Lords, Propertymark has stressed that a justice system which works well benefits everyone in the housing sector. Faster, clearer, and more accessible processes help prevent disputes from escalating and support better outcomes for tenants and landlords alike.

What this means for landlords managing tenancies

For landlords and letting agents, the government’s pledge to fund free legal support for tenants may lead to earlier intervention in tenancy disputes. This could reduce the number of cases reaching eviction proceedings, potentially saving time and legal costs.

Landlords should be aware that tenants now have greater access to legal advice and debt support, which may encourage more open dialogue and negotiation. This development underscores the importance of maintaining clear communication and thorough documentation throughout the tenancy to facilitate dispute resolution.

Moreover, landlords may find it beneficial to stay informed about the evolving housing justice landscape and court reforms to better navigate possession proceedings and tenancy management.
