Leaseholders Could Gain Right to Demand Superfast Broadband Under New Government Proposals

The government has launched a consultation proposing that leaseholders in flats be granted the right to request gigabit-capable broadband connections from freeholders, who would not be able to unreasonably refuse such requests. This development is part of a broader strategy to achieve 99% gigabit broadband coverage across the UK by 2032, addressing connectivity challenges in leasehold properties.

These proposed changes are significant for landlords and agents managing leasehold flats, as they may affect obligations regarding broadband installation and upgrades. Improved digital infrastructure is increasingly essential for tenant satisfaction and property value, making it important for landlords to understand the implications of these potential rights for leaseholders.

Background to the Proposed Broadband Rights for Leaseholders

Currently, leasehold flat owners do not have a formal legal right to request superfast or gigabit-capable broadband connections from their freeholders. This has often left leaseholders at a disadvantage compared to homeowners or tenants in houses, particularly in blocks of flats where installing high-speed broadband can be more complex.

The government’s consultation aims to address this disparity by enabling leaseholders to make a formal written request to their freeholder for a gigabit-capable broadband connection. The freeholder would be required not to unreasonably refuse such a request, thereby improving access to high-speed internet in leasehold properties.

Minister for Telecoms, Liz Lloyd, emphasised the importance of fairness and connectivity for all consumers, stating: “Measures like these are about fairness and improving the playing field for consumers, giving them better broadband connectivity. Whether you’re in a block of flats, a house, or a rural property, we want everyone to have access to the fast, reliable broadband needed for modern life.”

Details of the Proposed Measures

Under the proposed framework, leaseholders would need to submit a formal written request to their freeholder specifying the desire for an appropriate gigabit-capable broadband connection and identifying the relevant property. Importantly, the consultation clarifies that leaseholders would not be required to provide technical details, building plans, or installation arrangements as part of their request. This reduces the burden on leaseholders who may lack technical expertise.

The proposals also allow leaseholder landlords to apply for the broadband upgrade on behalf of their tenants, which could streamline the process in rented leasehold flats.

Implications for Landlords and Property Managers

For landlords and agents, these proposals could introduce new responsibilities related to facilitating broadband upgrades in leasehold flats. While the right to request broadband would rest with leaseholders, freeholders and managing agents may need to coordinate installation works, ensure compliance with building regulations, and manage any disruption sensitively.

Andrew Bulmer, CEO of The Property Institute, welcomed the consultation but highlighted the importance of professional standards in installation work: “Reliable, superfast broadband is no longer a ‘nice to have’ in the modern world and is essential for many of us to live and work. Too many leaseholders have been left behind in the digital transition, and we welcome the opportunity for them to upgrade the digital infrastructure in their homes. As ever, it will be important that any installation work is carried out by qualified professionals and managed by experienced property managers who understand the nature of tall and complex buildings to ensure that building quality and safety are not compromised.”

Landlords should prepare for potential requests by considering how broadband infrastructure is currently managed within their properties and exploring relationships with trusted broadband providers. Ensuring that any installation complies with health and safety standards and does not adversely affect the building’s fabric will be critical.

Next Steps and Consultation Details

The government consultation is open until 16 February and seeks views on the proposed legislative changes, including whether renters face similar connectivity challenges in leasehold flats. The outcome will inform future regulations aimed at improving broadband access for leaseholders.
